Who we are
Kelpie Diesel is a trading name of Diesel Tech Australia (ABN [ABN], ACN [ACN]), [ADDRESS]. Email [EMAIL] or phone +61 468 642 380.
These terms apply to every order placed on this website. Please also read our Returns, Refunds & Warranty, Shipping & Delivery, Fitment & Installation and Performance Parts & Legal Compliance pages, which form part of these terms.
Your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot be excluded. Where these terms say "to the extent permitted by law", they are subject to those rights.
Prices and payment
- All prices are in Australian dollars (AUD) and include GST unless we say otherwise.
- Freight is shown at checkout before you pay. The total you see at checkout is the total you pay.
- We take payment at checkout through our payment processor, Stripe. We never see or store your full card number.
- If we charge a card surcharge, it is shown before you pay and is no more than our cost of accepting that card.
- We email you a tax invoice for every order.
- Trade prices are only for approved trade account holders.
When your order is accepted
Placing an order is an offer to buy. A contract is formed when we email you to confirm that your order is accepted or dispatched. A payment receipt alone is not acceptance.
We may decline an order before acceptance, for example if the item is out of stock, the price or description is wrong, we cannot deliver to your address, or we reasonably suspect fraud. If we decline an order, we refund everything you paid within 5 business days.
Stock
Stock levels on the website are a guide. If an item you paid for is not available, we will tell you and you can choose a full refund or to wait for new stock.
Pricing and description errors
If a price or description is clearly wrong, we will contact you before dispatch. You can then pay the correct price or cancel for a full refund. We will never charge you more than the price you agreed to without your consent.
Cancelling an order
You can cancel any order before it is dispatched by contacting us, and we will refund you in full. After dispatch, our Returns, Refunds & Warranty page applies.
Special-order items. If a listing says "special order", we order it from our supplier for you. Once we have placed that order, you can still cancel, but we may deduct any cancellation or return fee our supplier actually charges us. We will tell you the amount before you decide. This does not apply if the item is faulty or not as described.
Core charges
Some exchange parts (such as turbochargers or injectors) carry a refundable core charge, shown on the listing. We refund the core charge when we receive your old part and it meets the core conditions shown on the listing.
Choosing the right part
You are responsible for checking that a part suits your vehicle before you order or fit it. See Fitment & Installation. If we give you fitment advice and it is wrong, your ACL rights apply.
Our liability
To the extent permitted by law:
- we are not liable for loss that was not reasonably foreseeable at the time of your order;
- we are not liable for loss caused by incorrect fitting by someone other than us, misuse, accident, or use of the part in a way it was not designed for; and
- for goods or services not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to (at our option) replacing or repairing the goods, paying the cost of doing so, or supplying the services again or paying the cost of having them supplied again.
This section does not limit our liability for loss caused by our negligence, or anything else that cannot be limited by law.
Privacy
We handle your personal information under our Privacy Policy.
Changes to these terms
We may update these terms from time to time. The version on this page when you place an order is the version that applies to that order.
Law and disputes
These terms are governed by the laws of Western Australia. If there is a problem, please contact us first and we will try to fix it. You can also contact Consumer Protection WA or your local consumer affairs or fair trading agency. Any court proceedings may be brought in the courts of Western Australia, or any other Australian court that has jurisdiction.
If any part of these terms is found to be invalid or unenforceable, the rest of the terms still apply.
